PAYING CORRECTLY

IT'S NOT A CHOICE

Anyone who is an employee or worker must be paid the National Minimum Wage (NMW).

This includes both the hours stated in their contract of employment and any overtime worked.

Failure to do so may result in an underpayment of the NMW.

MISTAKES CAN BE COSTLY

If you identify a NMW underpayment then you must inform your employee and put it right straight away. Penalties for incorrect payment can include:

  • HMRC issuing a notice to pay money owed, going back a maximum of 6 years.
  • A 200% fine of the total under payment for all workers. Maximum penalty is £20,000 per worker.
  • Legal action including criminal legal proceedings.
  • Your business may be publicly named on the Name List.

Contact the HMRC: If you identify an underpayment and are unsure what to do next you can contact the HMRC. They will not issue penalties to employers who come forward.

Contact the EEA legal helpline: If you have concerns about underpayments, deductions, or have been threatened with court action then the EEA free legal helpline is there to support you.
