WHY IS PAYING CORRECTLY IMPORTANT

ITS NOT A CHOICE

Anyone who is an employee or worker is entitled to be paid in line with National Minimum Wage (NMW) legislation. They must be paid at least the NMW for every hour worked. This includes both the hours stated in their contract of employment and any extra hours worked. Overtime must be paid, or TOIL given for extra hours. Failure to do so may result in an underpayment of the NMW.

Those who are self-employed set their own hourly rate.

MISTAKES CAN BE COSTLY

If you identify a NMW underpayment then you must inform your employee and put it right straight away. Penalties for incorrect payment can include:

  • Issuing a notice to pay money owed, going back a maximum of 6 years
  • Issuing a fine of up to £20,000 and a minimum of £100 for each employee or worker affected, even if the underpayment is worth less
  • Legal action including criminal legal proceedings
  • Your business may be publicly named
YOU CAN GET HELP

Contact the HMRC: If you identify an underpayment and are unsure what to do next you can contact the HMRC. They will not issue penalties to employers who come forward.

Contact the EEA legal helpline: If you have concerns about underpayments, deductions, or have been threatend with court action then the EEA free legal helpline is there to support you.
